From January 1, 2011, Applicants of European (PCT) patent applications claiming the priority of an earlier application are obliged to submit to the EPO the result of a prior art search carried out for the earlier application. The search result must be submitted together with the European patent application at the time of filing, with a Euro-PC application with the entry into the European phase, or without any delay after the result has been available to the Applicant.
The German Patent and Trademark Office (GPTO) recently reported that the number of applications for patents, utility models, trademarks, and design patents in 2010 remain to be stable at the high level of 2009.
Due to the revisions of the implementing regulations of the EPC (European Patent Convention), which entered into force on april 1, 2010, and serve to accelerate the examination proceedings of European patent applications, the EPO (European Patent Office) made some changes of PACE (by filing PACE requests, Applicants can accelerate the examination of applications).
